Extradition Of Kim Davy

Will the Minister of EXTERNAL AFFAIRS be pleased to state :- 

(a) whether Government is planning to get Mr. Kim Davy extradited to India in arms drop case of Purulia district in West Bengal;

(b) if so, the details thereof; and

(c) the details of action taken/being taken by Government in the matter?


ANSWER

THE MINISTER OF STATE IN THE MINISTRY OF EXTERNAL AFFAIRS
(SMT. PRENEET KAUR)

(a) to (c) Government has made strenuous diplomatic efforts to get Mr. Niels Holck alias Kim Davy extradited from Denmark. A formal request was made to the Danish Government in April 2002 and taken up thereafter on several occasions with that Government. The Danish Government agreed to do so on April 2010 after prolonged negotiations. Mr. Niels Holck alias Kim Davy appealed against the decision of the Danish Government in the City Court which ruled against the extradition on November 1, 2010. The City Court decision was immediately appealed against by the Danish Government. The matter was heard in the Eastern Court in Denmark from 16 to 19 May, 2011. The judgment delivered on June 30, 2011 upheld the judgment of the City Court and ruled against the extradition.
Soon after the Eastern Court of Denmark gave its judgment, Government conveyed its extreme disappointment at the highest levels to the Government of Denmark and urged it to appeal against it. However, on July 7, 2011, Danish Director of Public Prosecution announced the decision not to appeal the verdict of the Eastern High Court. Government’s disappointment and concerns were again conveyed to the Danish Government and it was emphasized that the judgment had grave and far-reaching implications and could only serve as an encouragement to terrorists and criminals. The grounds cited by the Danish Court as the basis for its decision were completely rejected by the Government. Government’s demand for extradition of Mr. Niels Holck alias Kim Davy to India stands.

Conservation Of Peacock In The Country

Will the Minister of ENVIRONMENT AND FORESTS be pleased to state :-

(a) the details of the peacocks killed during the last three years across the country;

(b) whether it is a fact that about 300 peacocks have been killed in Bundi district alone in Rajasthan in the past one year;

(c) whether districts like Bundi, Bharatpur, Nagaur and Ajmer are infamous for the poaching of the national bird; and

(d) if so, the steps and measures taken by Government to stop poaching of peacock and protect them?


ANSWER


MINISTER OF STATE (INDEPENDENT CHARGE) FOR ENVIRONMENT AND FORESTS (SHRIMATI JAYANTHI NATARAJAN)


(a) The details of peacocks killed across the country are not collated in the Ministry.

(b) In Bundi district, 32 peacocks have been reported killed in the past one year i.e. during 2010-11.

(c) No, Sir, However, as informed by the State Forest Department, Rajasthan, stray incidents of killing of peacocks reported in Bundi , Bharatpur , Nagaur and Ajmer districts during last three years are as under: - Ajmer 69 Bharatpur 10 Nagaur 7 Bundi 84

(d) The Steps taken the Government to stop poaching of peacock and to protect them are as under:-

(i) Peacock has been included under the Schedule – I of the Wild Life (Protection) Act, 1972 thereby affording this species the highest degree of legal protection.

(ii) Law enforcement authorities in the States maintain strict vigil against poaching of peacocks.

(iii) Wildlife Crime Control Bureau has been set up to gather intelligence about poaching and unlawful trade in wild animals and animal articles, including peacocks, and to achieve inter-state and trans-boundary coordination in enforcement of wildlife laws.

Misuse Of Funds Earmarked For NRHM

Will the Minister of HEALTH AND FAMILY WELFARE be pleased to state :-

(a) the details of funds allocated to States under National Rural Health Mission (NRHM) during the last three years;

(b) the details of funds spent;

(c) the details of funds spent by the States on procurement;

(d) whether Government has received any complaint regarding misuse of funds allotted to States under NRHM;

(e) if so, the status thereof; and

(f) the actions taken or being taken by Government in this regard?


ANSWER

THE MINISTER FOR HEALTH AND FAMILY WELFARE
(SHRI GHULAM NABI AZAD )

(a) & (b): The details of funds allocated to different States under NRHM and funds reported to be utilized by the States during the financial years 2008-09,

2009-10 and 2010-11 is as follows: Year Funds allocated by Govt. of India

(Rs. in crores) Funds utilized

( Rs. in crores) 2008-09 10,192.23 10,565.10 2009-10 11,581.31 13,226.01 2010-11 12,923.26 16,044.47
Funds utilized include allocation by Government of India, State’s contribution and uncommitted unspent balances relating to earlier years.

(c): An amount of Rs. 400.36 crores, Rs. 413.81 crores and Rs. 465.34 crores has been reported to be spent by the States on procurement under Mission and RCH Flexible Pools during the Financial Years 2008-09, 2009-10 and 2010-11 respectively.

(d) to (f): Complaints received from time to time, are immediately drawn to the attention of the State Government for necessary action. In addition, the following mechanisms have been put in place for adherence to financial procedures:

(a) Quarterly Financial Monitoring Reports to be submitted by the State;

(b) Annual Statutory Audits;

(c) Concurrent Audit; and

(d) Visits by the teams of the Financial Management Group of the Ministry to States for periodical reviews.
Deficiencies / shortcomings noticed during the reviews are immediately brought to the notice of the States for remedial action.
