However, the National Investigation Agency (NIA) Special Court, Patiala House, New Delhi has sought the presence of David Coleman Headley in NIA Case No.04/2009 for his prosecution. This case relates to a criminal conspiracy hatched by David Coleman Headley in 2006 with members of Lashkar-e-Toiba (LeT) and Harkat-ul-Jihad-e-Islami (HuJI) to commit terrorist acts in New Delhi and other places in India.
