Lifting Ban On Investments From Pakistan

Will the Minister of COMMERCE AND INDUSTRY be pleased to state:

(a) whether Government is considering to lift the ban on investments from Pakistan in return for concessions from across the border;

(b) if so, the details thereof;

(c) whether Government is also considering Foreign Direct Investment at par with those from Bangladesh; and

(d) if so, the details in this regard ?

ANSWER

(a) to (d): As per extant policy on Foreign Direct Investment (FDI), as contained in ‘Circular 2 of 2011 – Consolidated FDI Policy’, effective from 1.10.2011, issued by the Department of Industrial Policy and Promotion, a non-resident entity (other than a citizen of Pakistan or an entity incorporated in Pakistan) can invest in India, subject to the FDI Policy. A citizen of Bangladesh or an entity incorporated in Bangladesh can invest only under the Government route.

No decision has been notified by Government in regard to permitting investments from Pakistan on par with Bangladesh.

Pakistani Nationals Jailed For Terrorist Activities

(a) the details of Pakistani nationals who have been jailed for terrorist activities across the country;
(b) the details of expenditure incurred on their security or otherwise;
(c) the details of Pakistani nationals awarded capital punishment; and
(d) the number of persons hanged/awarded death penalty till date?

ANSWER

(a) to (d): A Statement is laid on the Table of the House.
STATEMENT IN REPLY TO PARTS (a) TO (d) OF THE RAJYA SABHA STARRED QUESTION NO.145 FOR 10.08.2011
(a): As per the available inputs, 130 Pakistani Nationals are currently lodged in various Indian jails for their involvement in terrorist and terrorism related activities across the country.
(b): ‘Prison’ is a State subject as per the VII Schedule of the Constitution of India. Expenditure on prisons and prisoners is therefore incurred by the State Governments. Central Government thus does not maintain any account of the expenditure incurred on security and other heads on prisoners lodged in various jails across the country.
(c): At present, the following three Pakistan nationals currently lodged in Indian jails have been sentenced to death for their involvement in terrorist activities :- Sl. No. Name & Parentage Jail where lodged
1. Mohd. Arif @ Abu Hamid @ Ashfa s/o Mohd. Akram CJ Tihar, Delhi
2. Md. Husain @ Abu Husain s/o Nazir Husain CJ Tihar, Delhi
3. Mohd. Ajmal Mohd. Amir Kasab @ Abu Mujahil Mumbai Central Prison
(d): As per the available information, the stage of appeal in respect of the said Pakistani prisoners who have been sentenced to death, is as under :- Sl. No. Name & Parentage Stage of appeal

ISI Promoting Terrorism In J & K

Will the Minister of HOME AFFAIRS be pleased to state :-

(a) whether it is a fact that ISI send money through hawala dealers based in Pakistan to Delhi to promote terrorism in the State of Jammu and Kashmir;

(b) if so, the details thereof;

(c) the details of Hawala men arrested and cash recovered with Kashmir terror link during the last three years;

(d) whether Government has taken any action at appropriate level with the Government of Pakistan, to prevent further occurrences in the State;

(e) if so, the details thereof; and

(f) if not, the reasons therefor?

STATEMENT IN REPLY TO RAJYA SABHA UNSTARRED QUESTION No. 242 FOR 23.02.2011.

(a) to (f): There are no specific or verified inputs that ISI is sending money through hawala dealers based in Pakistan to Delhi to promote terrorism in J&K. However, a Multi Disciplinary Group at the State and Central level has been entrusted with the responsibility of enquiring into the sources of funding in Kashmiri Separatists. Provisions of Law are invoked whenever any actionable information/intelligence regarding suspected funds is received in this regard. Besides, India has consistently emphasized to Pakistan the need to implement its solemn commitments, including those given at the highest level that it would not permit the territory under Pakistan’s control to be used to support terrorism against India in any manner.

(b) if so, the details thereof;

(c) whether Government is also considering Foreign Direct Investment at par with those from Bangladesh; and

(d) if so, the details in this regard ?
