1063. SHRI Y. S. CHOWDARY:
Will the Minister of LABOUR AND EMPLOYMENT be pleased to state:
(a) the State-wise details of registered placement agencies engaged in providing domestic help across the country;
(b) whether it has come to the notice of Government that these placement agencies
are getting wages of domestic help directly from the employers and are paying only
meagre amounts to the domestic help;
(c) if so, the details thereof;
(d) whether Government has received any complaints against these placement
agencies for non-payment of wages to the domestic help and if so, the action taken
thereof; and
(e) the steps/measures taken by Government to prevent exploitation of
these domestic help by the placement agencies?

(SHRI MALLIKARJUN KHARGE)
(a) Data regarding private placement agencies is not maintained centrally. However, State Governments have been asked to take necessary steps for registration of placement agencies including those providing domestic workers.

(b) No such instance has come to the notice of Ministry of Labour & Employment.

(c) Does not arise.
(d) & (e) The domestic work falls under the state sphere. The State Governments have been requested to take necessary steps for inclusion of domestic work in scheduled employment and fix minimum rate of wages for domestic workers.

Will the Minister of LABOUR AND EMPLOYMENT be pleased to satate :-

a) whether Government undertook ‘Skill Development Mission’ during the Eleventh Plan (2007-12) with an outlay of Rs. 22,800/- crores;
b) if so, the year-wise and State wise details of amount spent on this Mission so far;
c) whether any regional imbalances surfaced during this period and, if so, the reasons therefor and the corrective action taken;
d) whether the present public infrastructure is sufficient to achieve the desired results of the Mission or the involvement of private enterprise is necessary;
e) if so, the plans of Government; and
f) what is the present State-wise status of skill requirement and availability in major sectors?

STATEMENT REFERRED TO IN REPLY TO PARTS (a to f) OF RAJYA SABHA STARRED QUESTION NO. *26 BY SHRI Y. S. CHOWDARY REGARDING SKILL DEVELOPMENT MISSION DUE FOR REPLY ON 23.11.2011.


(a) & (b) Under Co-ordinate Action Plan for Skill Development , the following three institutions have been set up:

i. Prime Minister’s National Council on Skill Development-under the chairmanship of Hon’ble Prime Minister, for policy direction and review of spectrum of skill development efforts in country.
ii. National Skill Development Coordination Board-under the chairmanship of Dy. Chairman Planning Commission to enumerate strategies to implement the decisions of PM’s council and to coordinate with Union and State Governments as well as National Skill Development Corporation.
iii. National Skill Development Corporation (NSDC), a non-profit company under the Companies Act, 1956. The corporation is being funded by trust “National Skill Development Fund” to which the Government has contributed a sum of Rs.1,500 crore. The Corporation is expected to mobilize about Rs.15,000 crore from other government, public sector, private sector, bilateral and multilateral sources.

No specific budget allocation has been made for Skill Development Mission. However, different Ministries and Departments are carrying out skill development activities as part of their regular budget allocations.

(c) to (f) There are regional imbalances in different parts of the country. Skill development infrastructure is not evenly distributed and some regions viz hilly, border, difficult and desert areas are deficient in skill development infrastructure. Government has formulated scheme to set up1500 more Industrial Training Institutes and 5000 Skill Development Centers with active participation of private sector in these areas to reduce regional imbalance. State Skill Development Mission under the Chairmanship of Chief Ministers have also been set up to prepare state specific plan to address the skill deficit

State Governments have also been requested to carry out skill gap analysis in their states. However, National Skill Development Corporation has carried out study on requirement of skilled man power in twenty one high growth sectors, by 2022.

Registration Of Placement Agencies

Will the Minister of LABOUR AND EMPLOYMENT be pleased to satate :-


(a) whether it is mandatory for the placement agencies to register themselves with local police station across the country;

(b) if so, the details thereof; (C) whether Government has received any complaints against some placement agencies;

(d) if so, the details thereof;

(e) the details of cases booked/registered for minor abuse by the placement agencies; and

(f) the action proposed to be taken against the agencies involving in such activities?

(a) & (b): There are various types of private placement agencies operating in the country. On the basis of their regulation/coverage, these agencies can be broadly classified into four categories:
(i)Manpower Export and Placement Agencies- covered under Immigration Act, 1983 ;
(ii) Labour Contractors covered under Contract (Abolition & Regulation) Act, 1970 and the Inter-State Migrant Workmen(Regulation of Employment and Conditions of Service) Act, 1979;
(iii)Private Security Agencies – governed by Private Security Agencies(Regulation)Act,2005; and
(iv) Private Placement Agencies catering to specific needs of the employers/labour market or temporary workers and not covered under first three categories. The first three categories of private placement agencies have to obtain licence and register themselves with respective authorities as per the provisions of relevant Act/Rules. However, the fourth category of private placement agencies is not covered by any specific Act. Some States/UTs have issued guidelines to register them under their Shop & Establishment Act by the Labour Department. In order to safeguard the interest of jobseekers, Ministry of Labour & Employment issued guidelines on 30.10.2003 to the State Governments/ Union Territory Administrations to consider regulation of the functioning of Private Placement Agencies, as per local needs. These guidelines do not stipulate mandatory registration with local police station.

(c) to (f) Complaints, if any, are received by respective State Government/UT Administrations, and are dealt with by them as per the provisions of above mentioned Act(s) and /or provisions of Indian Penal Code. The details of these complaints are not maintained centrally.

(c) whether Government has taken any action against the erring officials; and
(d) if so, the details thereof?

(c) & (d): The officers of Regional Labour Commissioner (Central) conducted inspections in the project of Central sphere for ensuring the provision of Safety and Health for Building Workers and filed complaints against erring employers. During the year 2008, 2009 and 2010, 40, 20 and 18 prosecution were sanctioned and 21, 11 and 9 convictions were made respectively

Irregularities In Payment To Workers In CWG Projects

Will the Minister of LABOUR AND EMPLOYMENT be pleased to state :-

(a) whether Government have received any complaints of gross irregularities in the payment of minimum wages to the workers involved in the Commonwealth Games projects;

(b) if so, the status thereof;

(c) whether it is a fact that workers have been paid wages between Rs.110 and Rs.130 per day instead of the stipulated Rs.203 and on some sites they have been paid a weekly wage of Rs.300-400 while contractors pocketed rest of the amount;

(d) whether it is also a fact that workers have been denied weekly off during the construction activities in Commonwealth Games, 2010; and

(e) the action taken/being taken by Government against the erring contractors?

(a) to (e): Regular inspections were conducted by officials of the Central Industrial Relations Machinery (CIRM) in order to ensure that all statutory provisions were complied by contractors and the interest of contract workers involved in various Commonwealth Games related construction projects was safeguarded. However, some complaints have been received during the course of inspection and some cases of violation of payment of less than minimum wages were detected. In such cases, contractors were issued show cause notice and appropriate action taken including initiating prosecution against defaulters. The details relating to number of inspections, prosecution cases filed, claim cases filed and amount recovered and disbursed during January, 2008 to September, 2010 in this regard is annexed.
There is no such complaint regarding denial of weekly off to the workers. If the workers have been asked to work on weekly holidays, they have been given substituted weekly off on any other day.

  Accidents [other than DMRC sites] in different stadium/project-CWG 2010

1.       On 14-02-2008 at IGI airport – Accident took place at the site of L&T on the site of Delhi International Airport Ltd.[P]Ltd. Cause of accident due to wrong movement of the workmen- 01 died.

2.       On 14-12-2008  at Akshardham Village – Accident took place at EMAAR-MGF  site of DDA.  Cause-Due to technical failure of revolving tower crane- 01 died.

3.       On 09-01-2009 at IGI Airport – Accident at L&T at the site of L&T on the site of Delhi International Airport Ltd.[P]Ltd. Cause of accident due to fall of debris- 01 died.

4.       On 09-01-2010 at Akshardham Village-  Accident took place at EMAAR-MGF  site of DDA- Cause due to wood fire- one woman named Ms Menuka died.

5.       August 2010 at J.L.NehruStadia-   cause of accident- Girl child, named Varsha, aged about 2 years was knocked down by truck on the road who was sleeping on the footpath. On the direction of  Hon’ble High court of Delhi the CPWD has paid a compensation amount of Rs. 2,50,000/- to the family members.

6.       September 2010 at J.L.NehruStaadium-One ‘Khalasi’ of one of the transporter engaged by the Organising Committee[OC-CWG 2010] died on the spot.  Cause- the workman was sleeping below the truck.
